A chiarire le idee è intervenuta negli ultimi mesi la Corte di Cassazione, che si è pronunciata sempre più frequentemente sul tema negli ultimi quindici anni.
E' ormai pacifico che l'esame ematico-biologico, disposto d'ufficio dal giudice, possa essere utilizzato ai fini delle valutazioni giudiziarie in aggiunta ai classici elementi di prova cosiddetti presuntivi.
In particolare, grazie alla quasi assolutezza dell'esito a cui il test del DNA conduce, la Cassazione ritiene che esso possa essere sufficiente da solo ad accertare la paternità; addirittura il diniego di sottoporvisi è processualmente rilevante e viene utilizzato come elemento indiziario.
