Die gesellschaftspolitische Debatte rund um Deep Fake und Missbrauch fremder Identitäten ging auch am Schweizer Gesetzgeber nicht spurlos vorbei. Seit Herbst 2023 ist im Strafgesetzbuch der neue Straftatbestand des Identitätsmissbrauchs verankert. Die Lehre zeigt sich kritisch, aufgrund vieler Unklarheiten: Unter welchen Umständen mache ich mich künftig strafbar? Wenn ich Namen, Bild oder Stimme von anderen Personen verwende? Wenn ich dies als Jux mache, oder in betrügerischer Absicht? Und nicht zuletzt: Braucht es diesen Tatbestand überhaupt? Das diskutieren wir mit Gian Ege, Assistenzprofessor für Strafrecht und Strafprozessrecht an der Universität Zürich, unter anderem am Fallbeispiel Sibel Arslan/Andreas Glarner.
