Worum ging’s?
Versicherer hatten nach der BGH-Entscheidung vom 06.07.2016 viele Krankentagegeld-Bedingungen per „Klauselersetzung“ geändert (v.a. § 4 IV MB/KT:Herabsetzung des Tagessatzes). Jetzt hat der BGH klargestellt, wann solche Ersetzungen zulässig sind – im Lichte der EuGH-Rechtsprechung zu AGB (Art. 6 I RL 93/13/EWG).
