Das Gericht hat die Berufung des VN zurückgewiesen, dadieser den Nachweis eines versicherten Kfz-Diebstahls nicht erbringen konnteund eine arglistige Obliegenheitsverletzung begangen hat. Der VN konntelediglich das Abstellen des Fahrzeugs nachweisen, nicht jedoch dasunfreiwillige Nichtwiederauffinden. Seine Glaubwürdigkeit wurde verneint, da ereinen Vorschaden des Fahrzeugs verschwiegen und im Prozess widersprüchlichvorgetragen hat.
