Silence is not neutral.

Most people believe that doing nothingis a safe position.

It’s not.

Silence is interpreted.

Silence becomes agreement.Silence allows presumption to stand.

The courts have recognized that lack of notice and clarity can violate due process.

In Lambert v. California, the Court held that a person cannot be punished for failing to act when they had no reasonable notice.

Why?

Because awareness matters.

Understanding matters.

But here’s the problem:

If you never state your position…the record reflects acceptance.

Not because you agreed—but because you never objected.

Good faith replaces silence with clarity.

It puts your position on the record.

Because what is not said…is still used.
