    Complementary Protection and ReImmigration: When Integration Becomes a Legal Criterion Welcome to a new episode of the podcast Integration or ReImmigration.
    My name is Fabio Loscerbo, I am an Italian attorney, and in this episode I want to address a central issue in today’s immigration debate: the relationship between complementary protection and ReImmigration, in light of recent decisions by Italian courts. In recent years, the idea has spread that complementary protection represents an automatic right to remain in Italy, almost a shortcut around return and removal policies. This narrative is incorrect. And this is not an ideological statement, but a legal one. It is not supported by statutory law, nor by recent case law. Complementary protection, currently governed by Article 19 of the Italian Immigration Act, as amended by Decree-Law number 20 of 2023, is neither an easy nor a generalized form of protection. It is a residual safeguard, applicable only when the removal of a foreign national would result in a violation of Italy’s constitutional or international obligations, in particular the right to respect for private and family life. This is where a crucial point emerges. Protection is not based on abstract claims, but on concrete facts. Courts require proof of genuine rooting in the host country. Lawful employment, legitimate income, housing stability, social relationships, and respect for the rules. In one word: real integration. A recent decision by the Court of Bologna makes this very clear. Complementary protection was granted not because the individual was merely present in Italy, but because he demonstrated, even in a relatively short period of time, a real integration into the social and economic fabric of the country, without posing any threat to public order and without violating fundamental rules of civil coexistence. This is also a key point for understanding the meaning of the Integration or ReImmigration paradigm. Complementary protection is not an alternative to ReImmigration. On the contrary, it confirms it from a legal perspective. It functions as a filter. Those who truly integrate remain. Those who fail to integrate, or who systematically violate the rules, exit the system. Case law is very clear on this as well. There is no obligation on the State to guarantee economic well-being or better living conditions to individuals who have not built a genuine path of integration. And there is no absolute right not to be removed. Each case requires a serious and concrete balancing between individual rights and public interests, such as security and public order. From this perspective, integration is not a political slogan or an empty formula. It is a legal criterion. It is an individual responsibility. And it is the condition that legitimizes continued residence in the national territory. ReImmigration, therefore, is not a punitive or ideological measure. It is the natural consequence of failing to respect that implicit pact linking rights and duties. Without real integration, protection cannot stand. And without clear rules, no credible immigration system can exist. Law, when applied without hypocrisy, shows that it can distinguish. It can protect those who build. And it can remove those who refuse the rules. This is exactly the logic behind the Integration or ReImmigration paradigm. Thank you for listening to this episode.

    Mi nombre es Fabio Loscerbo, soy abogado en Italia, y en este episodio quiero abordar un tema central en el debate actual sobre inmigración: la relación entre la protección complementaria y la ReInmigración, a la luz de las decisiones más recientes de los tribunales italianos. En los últimos años se ha difundido la idea de que la protección complementaria representa un derecho automático a permanecer en Italia, casi un atajo frente a las políticas de retorno. Esta narrativa es incorrecta. Y no lo digo por razones ideológicas, sino jurídicas. No encuentra respaldo ni en la ley vigente ni en la jurisprudencia más reciente. La protección complementaria, regulada actualmente por el artículo 19 del Texto Único de Inmigración, tras las modificaciones introducidas por el Decreto-ley número 20 de 2023, no es una forma de protección fácil ni generalizada. Es una tutela residual, aplicable únicamente cuando la expulsión de una persona extranjera implicaría una violación de las obligaciones constitucionales o internacionales del Estado italiano, en particular del derecho al respeto de la vida privada y familiar. Aquí surge un punto fundamental. La protección no se basa en afirmaciones abstractas, sino en hechos concretos. Los tribunales exigen la prueba de un arraigo real en el país de acogida. Trabajo regular, ingresos lícitos, estabilidad habitacional, relaciones sociales y respeto de las normas. En una palabra: integración real. Una decisión reciente del Tribunal de Bolonia lo deja muy claro. La protección complementaria fue reconocida no porque la persona estuviera simplemente presente en Italia, sino porque demostró, incluso en un período relativamente breve, una integración efectiva en el tejido social y económico del país, sin generar alarma social ni violar las reglas fundamentales de la convivencia civil. Este aspecto es clave también para comprender el significado del paradigma Integración o ReInmigración. La protección complementaria no es una alternativa a la ReInmigración. Al contrario, la confirma desde un punto de vista jurídico. Funciona como un filtro. Quien se integra de verdad permanece. Quien no se integra, o quien viola sistemáticamente las normas, sale del sistema. La jurisprudencia es muy clara también en este punto. No existe obligación alguna para el Estado de garantizar bienestar económico o mejores condiciones de vida a quienes no han construido un verdadero proceso de integración. Y no existe un derecho absoluto a no ser expulsado. Cada caso requiere una ponderación seria y concreta entre los derechos individuales y los intereses públicos, como la seguridad y el orden público. Desde esta perspectiva, la integración no es un eslogan político ni una fórmula vacía. Es un criterio jurídico. Es una responsabilidad individual. Y es la condición que legitima la permanencia en el territorio nacional. La ReInmigración, por tanto, no es una medida punitiva ni ideológica. Es la consecuencia natural del incumplimiento de ese pacto implícito que vincula derechos y deberes. Sin integración real, la protección no puede sostenerse. Y sin reglas claras, no puede existir un sistema creíble de gestión de la inmigración. El derecho, cuando se aplica sin hipocresías, demuestra que sabe distinguir. Sabe proteger a quienes construyen. Y sabe apartar a quienes rechazan las reglas. Esta es precisamente la lógica del paradigma Integración o ReInmigración. Gracias por escuchar este episodio.

    Mein Name ist Fabio Loscerbo, ich bin Rechtsanwalt in Italien, und in dieser Folge möchte ich ein zentrales Thema der aktuellen Migrationsdebatte behandeln: das Verhältnis zwischen komplementärem Schutz und ReImmigration im Lichte der jüngsten Entscheidungen der italienischen Gerichte. In den letzten Jahren hat sich die Vorstellung verbreitet, der komplementäre Schutz stelle ein automatisches Recht dar, in Italien zu bleiben – gewissermaßen eine Abkürzung zu den Rückführungs- und Abschiebungspolitiken. Diese Darstellung ist falsch. Und das ist keine ideologische Aussage, sondern eine rechtliche. Sie findet weder im geltenden Recht noch in der jüngeren Rechtsprechung eine Grundlage. Der komplementäre Schutz, der derzeit in Artikel 19 des italienischen Einwanderungsgesetzes geregelt ist und durch das Gesetzesdekret Nummer 20 aus dem Jahr 2023 geändert wurde, ist weder eine einfache noch eine allgemeine Schutzform. Es handelt sich um eine subsidiäre Schutzmaßnahme, die nur dann greift, wenn die Entfernung einer ausländischen Person eine Verletzung der verfassungsrechtlichen oder internationalen Verpflichtungen des italienischen Staates darstellen würde, insbesondere des Rechts auf Achtung des Privat- und Familienlebens. Hier zeigt sich ein entscheidender Punkt. Schutz beruht nicht auf abstrakten Behauptungen, sondern auf konkreten Tatsachen. Die Gerichte verlangen den Nachweis einer tatsächlichen Verwurzelung im Aufnahmestaat. Rechtmäßige Beschäftigung, legales Einkommen, stabile Wohnverhältnisse, soziale Beziehungen und die Achtung der Regeln. Mit einem Wort: echte Integration. Eine aktuelle Entscheidung des Gerichts von Bologna bringt dies sehr deutlich zum Ausdruck. Der komplementäre Schutz wurde nicht deshalb gewährt, weil die betroffene Person lediglich in Italien anwesend war, sondern weil sie – selbst in einem relativ kurzen Zeitraum – eine tatsächliche Eingliederung in das soziale und wirtschaftliche Gefüge des Landes nachgewiesen hatte, ohne eine Gefahr für die öffentliche Ordnung darzustellen oder grundlegende Regeln des gesellschaftlichen Zusammenlebens zu verletzen. Dieser Aspekt ist auch für das Verständnis des Paradigmas Integration oder ReImmigration von zentraler Bedeutung. Der komplementäre Schutz ist keine Alternative zur ReImmigration. Im Gegenteil, er bestätigt sie aus rechtlicher Sicht. Er fungiert als Filter. Wer sich tatsächlich integriert, bleibt. Wer sich nicht integriert oder die Regeln systematisch missachtet, scheidet aus dem System aus. Auch die Rechtsprechung ist in diesem Punkt eindeutig. Es besteht keine Verpflichtung des Staates, wirtschaftliches Wohlergehen oder bessere Lebensbedingungen für Personen zu gewährleisten, die keinen echten Integrationsprozess aufgebaut haben. Ebenso wenig gibt es ein absolutes Recht, nicht abgeschoben zu werden. Jeder Einzelfall erfordert eine ernsthafte und konkrete Abwägung zwischen individuellen Rechten und öffentlichen Interessen, wie Sicherheit und öffentlicher Ordnung. Aus dieser Perspektive ist Integration kein politisches Schlagwort und keine leere Formel. Sie ist ein rechtliches Kriterium. Sie ist eine individuelle Verantwortung. Und sie ist die Voraussetzung, die den weiteren Aufenthalt im Staatsgebiet legitimiert. ReImmigration ist daher keine punitive oder ideologische Maßnahme. Sie ist die natürliche Folge der Missachtung jenes impliziten Pakts, der Rechte und Pflichten miteinander verbindet. Ohne echte Integration kann kein Schutz bestehen. Und ohne klare Regeln kann es kein glaubwürdiges Migrationssystem geben. Das Recht zeigt, wenn es ohne Heuchelei angewendet wird, dass es unterscheiden kann. Es schützt diejenigen, die aufbauen. Und es entfernt diejenigen, die die Regeln ablehnen. Genau das ist die Logik des Paradigmas Integration oder ReImmigration. Vielen Dank fürs Zuhören.
