About this listen
In episode 17 of the Supreme Court Opinions Read podcast, we read the Supreme Court's opinion in Bowe v United States. There are two issues in this case:
(1) Whether Section 2255(h)'s cross-reference to Section 2244 includes Section 2244(b)(3)(E), thereby barring the Supreme Court from exercising certiori jurisdiction over federal prisoners' petitions for authorization to file second or successve petitions for postconviction relief.
(2) Whether the same cross-reference includes Section 2244(b)(1), thereby barring federal prisoners' petitions for postconviction relief if they raise claims raised in previous petitions.
